Vehicular Homicide
My client was charged with vehicular homicide for the death of a pedestrian. A vehicle had broken down and was parked partially on the side of the road. A deputy sheriff was directing traffic when my client came over a blind hill driving a truck pulling a trailer. The deputy was standing in my client’s lane and my client had to slam on his brakes, causing his truck and trailer to jack knife, hitting the innocent pedestrian. The Georgia State Patrol specialized collision reconstruction team investigated and came to the conclusion that my client was at fault. A defense expert testified that the wreck was the fault of the deputy sheriff and the sheriff’s department in general. A jury took less than 20 minutes to find my client not guilty of vehicular homicide.
